Yonkers residents Feliciano Perez Bautista, 31, Jorge Arce Villano, 26, and a third unnamed suspect who remains at large, have been indicted by a Westchester County grand jury for their roles in the death of Efigenio Jose Rojas in July.
Villano and the third suspect have been charged with first-degree manslaughter and gang assault. Bautista has been charged with second-degree gang assault, all felonies.
It is alleged that at approximately 2 a.m. on July 8, the three men encountered Rojas in a New Main Street restaurant in Yonkers. Westchester County District Attorney Anthony Scarpino, Jr., said that words were exchanged between the unnamed suspect and Rojas. The exchange erupted into violence which spilled into the street.
Outside, the fight escalated to the point where the three co-conspirators joined in beating Rojas to unconsciousness. When the three men fled the area a Good Samaritan obtained aide for Rojas, who was taken to the hospital with serious injuries and died days later.
Bautista and Villano are scheduled to appear back in court on Tuesday, Nov. 12.
